OPEN ONLY TO LEGAL RESIDENTS OF 48 CONTIGUOUS UNITED STATES & DISTRICT OF COLUMBIA, 21 YEARS AND OLDER WHO HAVE A VALID DRIVER'S LICENSE AS OF 9/17/08
HOW TO ENTER: "2008 PUROLATOR® BOAT/TRUCK SWEEPSTAKES" ("SWEEPSTAKES") starts 2/22/08 at 12:00:01 A.M., ET and ends 8/31/08 at 11:59:59 P.M., ET ("Promotion Period"). You may enter the Sweepstakes, either: (A) Via Internet: Go to www.pureoil.com during the Promotion Period and follow the entry instructions. All online entries must be received by 8/31/08 at 11:59:59 P.M., ET; or (B) Bassmaster classic®: Visit the Purolator Booth at the Bassmaster Classic event, currently scheduled for 2/22/08 through 2/24/08 at Lake Hartwell, Greenville, SC; legibly complete an official entry form and deposit it in the official entry box during normal Booth hours. For additional details regarding the Bassmaster Classic, visit www.bassmaster.com. Mechanically reproduced entries not permitted. Submitted entries are the sole property of Robert Bosch LLC (hereinafter sometimes referred to as either "Sponsor" or "Purolator"), and will not be returned. Sponsor is not responsible for incomplete, lost, damaged, stolen, misdirected, late, illegible, mutilated or postage due entries or mail. Only one (1) entry per person or household regardless of method of entry.
2. Eligibility: Sweepstakes is open to all legal residents of the 48 contiguous United States and District of Columbia, 21 years and older who have a valid driver's license as of 8/31/08, except officers, directors, and employees (and members of their immediate families, i.e., spouse, parents, children, and siblings or household and persons residing with any of the foregoing) of Sponsor; Bass ("Bass"); their respective parent companies, subsidiaries, affiliated and related companies, divisions, representatives, advertising and promotion agencies, including Mercury Promotions & Fulfillment ("Mercury"); (collectively, "Released Parties"); and any other entities or individuals associated with this Sweepstakes. Residents of Puerto Rico, Guam, the Virgin Islands, U.S. territories and possessions are not eligible to enter or win.
3. Prize & Odds of Winning: Grand Prize (1): One (1) Grand Prize ("Winner") One (1) customized Purolator 21’ foot Triton® 21x2 boat with Mercury® 250 ProXS, Motorguide Trolling motor and Lowrance® Electronics that has been previously used in tournament fishing on the Bassmaster Tournament trail (ARV: $55,000), and one (1) 2008 Toyota Tundra SR5V8 Double Cab truck that has been previously used to tow the Triton boat (ARV: $35,000) Total ARV:$90,000 prior to use. Boat and truck will be transported to the Winner’s residence (Winner must take delivery in one (1) of the 48 contiguous United States) on or before 12/31/08 or forfeit the Grand Prize in its entirety and Sponsor will have no further obligation to Winner. Winner will not have a choice of color of boat or truck and must agree to accept delivery of the boat and truck “as is” at a location designated by Sponsor. Released Parties MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, REGARDING ANY PRODUCT OR COMPONENT PART OF ANY PRIZE. The only warranties which will apply are the manufacturers that may be in effect at the time of Winner's acceptance of the boat and truck. All taxes on the boat and truck and other expenses not specified herein (including, but not limited to, sales tax, luxury tax, use tax, gas consumption taxes, destination charges, registration, title and license fees, insurance, gas, maintenance and all other costs incurred in claiming, transferring, registering or using the boat and truck) are the sole responsibility of the Winner. Winner must be a licensed driver and must present proof of insurance and a valid driver's license upon acceptance of the truck. Boat or truck shown in any promotional materials is for illustration purposes only; boat and/or truck awarded to Winner may differ. Other restrictions may apply. Purolator is not responsible for any inability of the Winner to accept the Prize. Prize is not redeemable for cash; nor is it transferable or substitutable except by Purolator with a prize of equal or greater value. Winner will be issued a Form 1099 as required by the Internal Revenue Service and must supply Purolator with his/her Social Security Number for tax reporting purposes. Odds of winning depend on the total number of all eligible entries received regardless of method of entry. In no event will more than one Prize be awarded.
4. Random drawing: On or about 10/16/08, the name of the potential Winner will be selected in a random drawing conducted by an independent judging agency, from among the total number of all entries received regardless of method of entry. The decisions of the judges will be final in all matters pertaining to this Sweepstakes. The potential Winner will be notified by phone and/or mail on or about 10/31/08. Winner will be required to sign and return an Affidavit of Eligibility/Compliance and Liability/Publicity Release, where legal. If any prize notification or other mail is returned as non-deliverable or if potential Winner fails to sign and return these documents by the return date specified in the prize notification letter will result in forfeiture of Prize and selection of an alternate potential Winner.
5. Internet: Released Parties are not responsible for interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer transmissions or jumbled, scrambled or misdirected entries or transmissions, or for phone, electrical, network, computer hardware or software or program malfunctions, failures or difficulties or for other errors, omissions, interruptions, or deletions of any kind whether human, mechanical or electronic or for any damage to any person's computer related to participating in the promotion. Entries must be manually key-stroked; use of automated entry devices or programs is prohibited and all such entries will be void. Persons found tampering with or abusing any aspect of this Sweepstakes, as solely determined by Sponsor, will be disqualified and may be subject to prosecution. Any entrant who attempts to enter with multiple e-mail addresses, under multiple identities or uses any other device or artifice to enter the Sweepstakes multiple times or to in any way interfere with the proper play of this Sweepstakes, will be disqualified from participation in the Sweepstakes. If in the judgment of Sponsor, the Sweepstakes is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor, which corrupts the administration, security, fairness or proper play of that Sweepstakes, Sponsor reserves the right, in its sole discretion, to discontinue, suspend or terminate the Sweepstakes and select the Winner from among all eligible entries received to date, in a random drawing to be conducted by the judge following the discontinuation, suspension or termination of the Sweepstakes. Any personally identifiable information collected during an entrant's participation in this Sweepstakes will be collected by Sponsor and used by Sponsor, its affiliates, agents and marketers for purposes of the proper administration and fulfillment of the Sweepstakes as described in these Official Rules and in accordance with Sponsor's Privacy Policy as stated at www.pureoil.com. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF the sweepstakes IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a Winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
6. GENERAL/LIMITATIONS OF LIABILITY: By entering this Sweepstakes, entrants agree that they have read, understand, and agree to be bound by these Official Rules. Submission of entries and/or acceptance of Prize constitutes Winner's consent to the use of his/her name, photograph and/or likeness for advertising and publicity purposes, worldwide, as determined by Sponsor without further compensation or consultation, except where prohibited by law. By entering this Sweepstakes, entrants agree to release and hold harmless the Released Parties for any liability whether directly or indirectly, including, without limitation, liability in connection with any injuries, damages or losses of any kind, whether to person or property, including death, in connection with the Sweepstakes (including, without limitation, any liability and/or claims arising out of entrant's acceptance, use and/or misuse of any Prize and/or participation in this Sweepstakes, and they will be held harmless against any claims of liability arising directly or indirectly from any Prizes awarded or participation in this Sweepstakes. Released Parties are not responsible for unintelligible, late, or lost entries or incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human errors which may occur in the processing of any entries or in the administration of this Sweepstakes. All entries and/or materials submitted become the property of Sponsor and will not be returned. Sponsor, et al. are not responsible for any lost, late, undelivered, misdelivered, mutilated or postage due entries or mail. All federal, state and local laws and regulations apply. This Sweepstakes is subject to all applicable federal, state and local laws and regulations. The interpretation of these Official Rules shall be governed by the laws of the State of Michigan. Any and all disputes will be resolved in the appropriate courts in the State of Michigan exclusively, and subject to the laws of the State of Michigan. Should there be a conflict between the laws of the State of Michigan and any other laws, the conflict shall be resolved, individually and without resort to class action, in favor of the laws of the State of Michigan. Void in Puerto Rico, Guam, Virgin Islands, U.S. territories and possessions and wherever prohibited or restricted.
